These Terms & Conditions (“Terms”) govern the use of the Austa Painting & Decorating website and the provision of painting and decorating services by Austa Painting & Decorating (“we”, “our”, or “us”).

By using our website, requesting a quote, booking our services, or engaging us to perform work, you agree to these Terms.

1. Our Services

Austa Painting & Decorating provides professional painting and decorating services for residential and commercial properties.

Our services may include:

  • Interior painting
  • Exterior painting
  • Residential painting
  • Commercial painting
  • Repainting and restoration
  • Surface preparation
  • Feature walls
  • Doors, trims, and other painting work
  • Other painting and decorating services agreed with the customer

The specific services provided will depend on the scope of work agreed between us and the customer.

2. Quotes and Estimates

All quotes and estimates are based on the information available to us at the time of inspection or preparation of the quote.

A quote may take into account:

  • The size and condition of the property
  • Surface preparation requirements
  • Materials and paint products
  • Labour
  • Accessibility
  • Number of coats required
  • Repairs or additional preparation
  • Other conditions identified during inspection

Unless otherwise stated in writing, a quote is valid for 7 Days from the date of issue.

A quote does not include additional work that was not reasonably identifiable or included in the original scope of work.

If additional work is requested by the customer or becomes necessary due to conditions that could not reasonably be identified when the quote was prepared, we will discuss the additional cost with the customer before proceeding wherever reasonably possible.

3. Acceptance of a Quote

A customer may accept a quote by signing the quotation, confirming acceptance electronically, paying a required deposit, or otherwise confirming that they wish us to proceed.

Once accepted, the agreed scope of work, price, and other conditions will form the basis of the service agreement between the customer and Austa Painting & Decorating.

4. Changes to the Scope of Work

Any changes requested by the customer after acceptance of the quote may result in additional charges and/or changes to the completion date.

Examples include:

  • Additional rooms or surfaces
  • Additional coats
  • Additional repairs or preparation
  • Changes to colours after work has commenced
  • Changes to paint products or finishes
  • Additional decorating work

Where possible, we will provide the customer with details of additional costs before carrying out the additional work.

5. Customer Responsibilities

The customer is responsible for:

  • Providing accurate information about the property
  • Providing reasonable access to the property
  • Ensuring that utilities required to perform the work are available
  • Removing valuable, fragile, or personal items from work areas
  • Informing us of known hazards, defects, asbestos, water damage, structural issues, or other relevant property conditions
  • Obtaining any required permissions or approvals where applicable

We are not responsible for damage to items that the customer has not appropriately removed or protected from the work area.

6. Property Access

The customer must provide reasonable and safe access to the property at the agreed times.

If we are unable to access the property as scheduled, this may result in delays and, where applicable, additional costs.

Where keys, access codes, security systems, or other access arrangements are required, the customer must provide accurate instructions before work begins.


7. Preparation and Existing Surfaces

Painting results can depend significantly on the condition of existing surfaces.

Existing issues such as:

  • Cracks
  • Dampness
  • Water damage
  • Mould
  • Peeling paint
  • Uneven surfaces
  • Structural movement
  • Staining
  • Poor previous workmanship

may affect the final appearance and durability of the finished work.

Where such conditions are outside our reasonable control, we cannot guarantee that painting alone will permanently correct the underlying problem.

We may recommend additional preparation, repairs, treatment, or specialist services where appropriate.

8. Colours and Finishes

Customers are responsible for confirming their preferred colours, finishes, and paint products before work commences.

Colours may appear different depending on lighting, surrounding surfaces, screens, and existing colours.

Once a colour has been approved and applied, changes requested by the customer may be treated as additional work and may incur additional charges.

9. Paint and Materials

Unless otherwise agreed, we will use paint and materials appropriate for the agreed scope of work.

Where a customer requests a specific brand, product, colour, or finish, additional costs may apply.

Product availability may occasionally affect project schedules.

10. Payment

Payment terms will be specified in the quotation or invoice.

Unless otherwise agreed in writing:

  • Any required deposit must be paid before work commences.
  • Progress payments may be required for larger projects.
  • The final balance is payable upon completion of the agreed work.
  • All invoices must be paid by the due date stated on the invoice.

We reserve the right to suspend or delay work where payments are overdue.

11. Deposits

Where a deposit is required, the amount and payment terms will be stated in the quotation or agreement.

The treatment of deposits in the event of cancellation will depend on the circumstances and applicable Australian consumer law.

12. Cancellation and Rescheduling

Customers should provide as much notice as reasonably possible if they need to cancel or reschedule a booking.

Cancellation or rescheduling fees may apply where:

  • A booking is cancelled at short notice
  • Materials have already been purchased specifically for the project
  • Labour or subcontractors have been scheduled
  • Significant preparation has already been completed
  • The cancellation causes reasonable costs or losses to us

Any applicable cancellation charges will be communicated to the customer.

13. Delays

We will make reasonable efforts to complete work within the agreed timeframe.

However, completion dates may be affected by circumstances beyond our reasonable control, including:

  • Severe weather
  • Rain or excessive humidity
  • Material shortages
  • Supplier delays
  • Unexpected property conditions
  • Restricted access
  • Other contractors
  • Customer-requested changes
  • Events beyond our reasonable control

We will communicate significant delays to the customer where reasonably possible.

14. Workmanship

We aim to provide professional workmanship and complete work in accordance with the agreed scope.

Minor variations in texture, finish, colour, or appearance may occur due to the nature of painting and the condition of existing surfaces.

Where a customer identifies a genuine workmanship issue, they should notify us as soon as reasonably possible so that we can assess the issue and, where appropriate, arrange a reasonable remedy.

15. Defects and Rectification

If you believe there is a defect or issue with our work, please contact us promptly and provide reasonable details of the issue.

We may inspect the affected area to determine whether the issue is related to our workmanship, materials, existing property conditions, or another cause.

Where we are responsible for a genuine workmanship defect, we will take reasonable steps to rectify it in accordance with applicable law.

16. Warranty and Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot legally be excluded under applicable Australian consumer law.

Where a specific workmanship warranty is offered, the duration and conditions of that warranty will be stated separately in the quotation, invoice, or written agreement.

Any warranty may not cover problems caused by:

  • Structural movement
  • Moisture or water damage
  • Leaks
  • Rising damp
  • Mould caused by underlying conditions
  • Normal wear and tear
  • Damage caused by third parties
  • Incorrect maintenance
  • Changes to the property after completion
  • Conditions outside our reasonable control

17. Damage to Property

We will take reasonable care when performing our services.

However, customers should remove or secure valuable, fragile, or sensitive items before work begins.

We are not responsible for pre-existing damage or defects that were present before work commenced.

Where accidental damage occurs as a result of our negligence or failure to take reasonable care, we will assess the matter and respond appropriately in accordance with applicable law.

18. Health and Safety

We are committed to maintaining a safe working environment.

We may refuse or postpone work where we reasonably believe that conditions at the property are unsafe.

This may include situations involving:

  • Unsafe access
  • Dangerous structures
  • Hazardous materials
  • Electrical hazards
  • Uncontrolled animals
  • Significant mould or contamination
  • Asbestos or suspected asbestos
  • Other serious safety risks

Specialist contractors may be required for certain hazardous conditions.

19. Asbestos and Hazardous Materials

Customers must inform us of any known or suspected asbestos, lead paint, hazardous materials, or other dangerous substances at the property.

We may stop work if we discover or reasonably suspect the presence of hazardous materials.

Additional assessment, removal, or specialist treatment may be required before painting can safely continue.

20. Photographs and Project Images

Unless otherwise agreed, we may take photographs of completed work for quality control, documentation, portfolio, website, and marketing purposes.

We will take reasonable steps to avoid publishing personal information or identifying details of customers without permission.

Customers may contact us if they have concerns about the use of project photographs.

21. Website Information

We make reasonable efforts to ensure that information on our website is accurate and up to date.

However, website content is provided for general informational purposes and may change without notice.

We do not guarantee that the website will always be available, error-free, or completely accurate.

22. Third-Party Links
